How Much Is A Cerebral Palsy Birth Injury Lawsuit Worth?

Birth injuries are nowadays increasing in numbers. One of the happiest moments in a family is when a couple becomes parents of a child. Of course, this couple would expect a baby to be healthy and active, however, it is not always the case with newborn babies. It is impossible that all parents will have a healthy baby. There are many reasons for babies having birth injuries.

There are many types of birth injuries. For example, Cerebral Palsy, erbs palsy and other birth injuries are usually caused not by nature, but by the mistake of a doctor or hospital. For many parents, the cost to provide for a child with cerebral palsy can be overwhelming. While raising a child is expensive, raising a child with cerebral palsy can increase the cost of raising a child to over $900,000, depending on the case.

There are various cases of birth injuries and their severity can be different as well. There is no magical figure of what a person can receive for their child’s cerebral palsy birth injury. Each case will depend not only on the severity of the child’s injuries, but also on the specific facts of the case. A Florida lawsuit, in which a family of a girl who suffered from cerebral palsy because of a mistake by the hospital, ended with a jury awarding the family $19.2 million. Another trial ended with a family whose child suffered from cerebral palsy being awarded $13.9million. All in all, it seems that compensation depends on the type of cerebral palsy. Also, it is important to have an experienced birth injury attorney.

Nowadays, with the development of medicine, paradoxically there is a development of cases with negligence or malpractice. For example, a recent case that has gained national attention is the birth injury lawsuit filed by Lance and Jennifer Schneider against Protestant Memorial Hospital. The lawsuit alleges that their daughter suffered a serious brain injury after the doctor ruptured membranes in her head, failed to order an immediate C-section along with failure to use proper resuscitation techniques. The parents are suing for the cerebral palsy damages as well as the child’s disfigurement, disability, and pain and suffering.
