Judge Sends Reminder of Evidence Preservation in Fosamax Case

A reminder came to the parties of a Fosamax litigation to not dispose of any evidence in relation to the case. According to Judge F. Keenan, who is overseeing the pre-trial proceedings in the Southern district of New York, all evidence that may important to the case should be preserved. Evidence is considered such things as: records, all correspondence, invoices, documents and data. Electronic evidence is also crucial and is classified as: emails, network activity logs, hard drives and recorded telephone messages. Judge Keenan also reminded the counsel of their obligation to “exercise all reasonable effort” to notify employees whether institutional or that of corporate about their responsibility to the case. Fosamax is a bisphosphonate which change the cycle of breakdown and bone formation in the body. Fosamax helps slow the bone loss in humans and helps to increase the bone mass. Unfortunately, like with all other drugs, people taking Fosamax may suffer from side effects. Fosamax side effects include such things as: chest pain, pain or difficulty when swallowing, back pain, severe joint, bone, or muscle pain, jaw pain, numbness, and headache. While some side effects are mild and/or temporary, others can be indicative of something much more severe and should be treated promptly. This reminder should come as no surprise by Judge Keenan because previous orders were given after the original trial date had to be reset. Nothing related to the Fosamax case was to be destroyed until an agreement had been reached by both parties. One might wonder what prompted this reminder and what might such a preservation request place on defendant Merck & Co. According to Judge Keenan, “Until the parties reach an agreement on a preservation plan or the Court orders otherwise, each party shall take reasonable steps to preserve all documents, data and tangible things containing information potentially relevant to the subject matter of this litigation”.
