06/19/2012 Actos Lawsuit Filed in New York: On June 12th and Actos Lawsuit was filed in the United States District Court of New York by Richard Duffy, Plaintiff, against Takeda Pharmaceuticals America.Inc., Takeda Pharmaceuticals North America , Inc. and Eli Lilly and Company. Takeda Pharmaceuticals is a Japanese company with operations in the United States and elsewhere in the US.
This Actos Lawsuit adds to the large number of lawsuits filed based on a link between the diabetes drug Actos and bladder cancer. The United States Food and drug administration issued a statement on September 17th, 2010 stating it was reviewing a 10 year study regarding the link between Actos and Bladder Cancer. Despite the study and information released by the United States Food and Drug Administration, representatives of Takeda initially continued to deny that Actos increased the risk of Bladder Cancer. Actos was later removed from the market in France stemming a wave of controversy over the drug.
The Actos Lawsuit filed by Richard Duffy alleges that the manufacturers did not adequately warn the plaintiff or the plaintiff’s doctors and as a result of this failure to warn the plaintiff nor the plaintiffs prescribing doctor could not have known the risks associated with taking or prescribing Actos.
The failure to warn complaint faced by the defendants in Richard Duffys Actos Lawsuit are similar to those made in the large volume of Actos Lawsuits that have already been filed in U.S. Courts.
