Someone in the United States has a stroke every 40 seconds. Stroke is the third leading cause of death in America today— and a leading cause of long-term adult disability. The American Stroke Association’s definition says it all: “A stroke occurs when blood flow to the brain is interrupted by a blocked or burst blood vessel.” Period. But this sudden disruption can be years in the making. It can be the result of clogged blood vessels in the brain, the buildup over time of the fatty cholesterol deposits that translate into atherosclerosis. This disruption also can be created from a blood clot that travels to the brain from another part of the body, a clot that can become lodged in the blood vessels and, acting like a dam, stop¬ping the blood supply from getting through to hungry cells.</p>
<p>Or, less commonly, a stroke can be caused by a weakness in blood vessel walls. This vulnerability, present from birth or from uncontrolled high blood pressure, eventually can cause a blowout in the vessel. The blood then will hemorrhage, or leak out, into the brain. But whatever the disruption, the result is the same: the area beyond the clogged blood vessel, beyond the clot, beyond the hem¬orrhaging blowout, is not getting the blood supply that it needs. Like a lawn that isn’t watered in a drought, this area of the brain begins to dry up, to shrivel. The brain cells that aren’t “watered” will die very quickly.</p>
<p>TIA is a name to remember. It stands for transient ischemic at¬tack and it can save your life. Sudden blurred vision, numbness or weakness, or difficulty in speaking that lasts only a few min¬utes or less than twenty-four hours can be a sign that things are amiss—and that it’s time to take immediate care of yourself. In fact, if you experience these transient symptoms, you should call 911, immediately go to the emergency room, and hopefully pre¬vent a stroke.</p>
<p>Whoever coined “There’s more here than meets the eye&#8221; could very well have been a neurologist. Frankly, it’s not much to look at. A brain looks like a well-used sponge. But appearances lie. The brain is bursting with energy. It consists of billions of nerve cells called neurons. And these neu¬rons are settled in specific locales that are responsible for every¬thing from the way we eat to the food we like. And this so-called “sponge&#8221; can soak up so much information that nothing, not even the most sophisticated computer in the world, can compare to it. Nothing. As with most things, organization, delegation, and record keeping are crucial factors in its success. Despite its lumpy ap¬pearance, the brain is very active and very well organized—and in touch with all its “employees.&#8221;</p>

This “fist,” however, can squirt a jet of life-sustaining blood several feet. You can feel this jet of blood surging through your body by taking your pulse. Each beat of your pulse pushes out about one cup of blood into your bloodstream. But quality is more important than quantity. Believe it or not, our bodies contain only about twelve pints—or twenty-four cups—of blood. This is equivalent to approximately six quarts of milk or the weight of one Thanksgiving turkey.</p>
<p>The twelve pints of blood pumped by the heart are, in effect, used over and over again. They go around and around in an endless circle throughout our bodies, delivering the blood’s oxygen to all our organs and taking away their wastes. This process is called circulation. Briefly, here’s how it works: The heart is divided into four chambers, the. right and left atrium and the right and left ventricle. The oxygen-filled blood from the lungs comes into the left atrium of the heart. It moves into the left ventricle and is pumped out into the bloodstream through the aorta, the “king” of all arteries. From the aorta, blood, carrying our body’s fuel and food, travels through its passageways called arteries. The walls of the arteries are very elastic; they are muscular tubes that branch out, becom¬ing smaller and smaller, until they are only one cell thick.</p>
<p>Fuel and oxygen can pass through them. These tiny arteries are called capillaries. The hungry cells in the body, from the muscles to the brain, from the kidneys to the liver, “eat” their fill and deposit carbon dioxide through their cell walls. The depleted, waste-carrying blood now begins its journey home through the veins. The blood is now more sluggish. The heart has used most of its energy to pump oxygen-rich blood into the body; it has less “oomph” for the return trip. Thus, the veins have little “pockets” or valves that catch any “back¬flow” to make sure the blood keeps moving toward the heart and doesn’t get backed up. The veins get bigger and bigger until they reach the right atrium of the heart. As the heart pumps and clenches, this blood is pushed into the right ventricle, where it travels to the lungs and fills up once again with oxygen. This oxygen-rich blood journeys back to the left side of the heart, and the cycle begins anew.</p>

<p>The brain has a hungry man’s appetite. It needs 20 percent of the total blood supply to get the oxygen and food that it needs. The crucial arteries through which the heart pumps blood up to the hungry brain are called the carotid arteries. Both the right and the left carotid arteries are all-important, branching out into a series of arteries in the front of the neck and into the brain. These arteries grow smaller and smaller as they travel, allowing all the areas of the brain, from the thalamus to the hippocam¬pus, from the frontal to the temporal lobes, to get &#8220;served” with oxygen-rich blood.</p>

Problems can arise, however, in the most well-oiled ma¬chine—and the human body is no exception. Clotting is crucial if you fall and hurt your knee, if you step on that ever-present nail. However, especially as we get older, our arteries can narrow and develop rough areas, which draw the attention of the platelets.</p>

<p><em>Certified Structured Settlement Consultant:</em> Someone with this title is credentialed by the state and has successfully completed 80 hours of training and a rigorous comprehensive examination.</p>
<p><em>Claim: </em>In law, the relief sought by a plaintiff in a civil suit. In insurance, the form submitted following a loss or injury.</p>
<p><em>Consideration: </em>The benefit that is negotiated between two parties when entering into a contract. In a <strong>structured settlement</strong>, this includes the promise to pay the purchase price to the annuitant who is selling <strong>structured payment</strong><strong>s</strong>.</p>
<p><em>Contract: </em>A legal agreement that can be enforced by the court.</p>
<p><em>Discounted Value: </em>As it relates to <strong>structured settlements,</strong> a “discounted value” is what factoring companies use to make an offer to a client. What this means is that you will get less than the full value of your <strong>annuity payments</strong> or <strong>structured settlement</strong>; the difference is the factoring company’s fee for services rendered. This may also be referred to as an “effective discount rate.”</p>
<p><em>Factoring:</em> This is the process by which <strong>structured settlements</strong> or other future payment obligations are transferred to a third party for a Discounted Value.</p>
<p><em>Guaranteed Benefit: </em>Payments made regardless of whether or not the beneficiary survives the term (see “period certain” below). If the primary beneficiary dies before the end of the period, payments go to a designated heir, the beneficiary’s estate, or Assignee.</p>
<p><em>Internal Revenue Code: </em>The body of federal laws governing taxes in the U.S.</p>
<p><em>Irrevocable Trust: </em>A trust in which the creator has surrendered all rights to make changes or amendments. An irrevocable trust is used to protect assets against claims from creditors or other parties.</p>
<p><em>Judgment (or Court Order): </em>The ruling of the court. As it relates to <strong>structured settlements,</strong> the decision a judge makes to either approve or deny your request to transfer your <strong>structured settlement </strong>payments.</p>
<p><em>Lien: </em>A legal claim against an asset in order to insure the payment of an obligation. This may also be called an “encumbrance.”</p>
<p><em>Life Contingent Payments:</em> An annuity that continues to pay for as long as the beneficiary is alive. It may also be for a “period certain” (see below).  For example, “30 years certain and life annuity” means that <strong>annuity payments</strong> are guaranteed for no less than 30 years – but will continue should the beneficiary live beyond that time. On the other hand, if the beneficiary dies before the 30 years are up, the payments cease.</p>
<p><em>Lifetime Payments: </em><strong>Annuity payments </strong>that are guaranteed until the death of the beneficiary.</p>
<p><strong><em><a title="Lump Sum" href="http://www.cbcsettlementfunding.com/settlement-lump-sum/">Lump Sum</a> Annuity: </em></strong>An annuity that makes a single lump sum payment or increasingly larger payments (“balloon payments”) in the future.</p>
<p><em>Non-qualified Structured Settlement: </em>These are periodic payments that are not part of a personal injury settlement, such as punitive damages.</p>
<p><em>Obligor: </em> The party owing money to another as the result of a judgment or court settlement.</p>
<p><em>Period Certain: </em>A pre-determined period of time during which <strong><a title="structured payments" href="http://www.cbcsettlementfunding.com/selling-structured-settlement-payments/">structured payments</a></strong> are to be made, regardless of whether or not the beneficiary dies during that period.</p>
<p><em>Policy Limit: </em>The most an insurer is obligated to pay for a specific claim. This limit is specified in the declarations sheet.</p>
<p><em>Present Value: </em>Also known as “net present value, this refers to the value of a future structured income stream in today’s dollars. It is used in determining the discount rate of a <strong>structured settlement </strong>or annuity.</p>
<p><em>Qualified Assignment: </em>This is when the original party making payments to a lawsuit claimant or beneficiary transfers, or “assigns” those payment obligations to another party under regulations set forth in the Internal Revenue Code.</p>
<p><em>Risk: </em>This refers to the possibility that an asset or investment will not perform to expectations. <p><em>Settlement Agreement:</em> The legal contract between parties to litigation specifying how much and under what conditions the defendant must provide relief to the plaintiff.</p>
<p><em>Settlement Annuity:</em> This provides for structured payments over time for a successful plaintiff in a lawsuit.</p>
<p><em>Time Value of Money: </em>The value of money earning interest over a period of time. For example, if you were to invest $10,000 today at an annual 5% interest, it would be worth $10,500 in 12 months.  Therefore, your $10,000 has a future value of $10,500 and a present value of $10,000. This is taken into consideration in <strong>structured settlement </strong>transactions, as it permits the factoring company to determine the present value of an income stream.</p>

<p>One of these victims is the speaker of New Mexico’s House of Representatives.  The <a rel="nofollow" href="http://www.riograndesun.com/articles/2012/01/18/news/doc4f16f8d573d43570852414.txt" target="_blank">Rio Grande Sun</a> reports that Rep. <a rel="nofollow" href="http://www.nmlegis.gov/lcs/legdetails.aspx?SPONCODE=HLUJA" target="_blank">Ben Lujan</a> intends to step down because of advanced lung cancer he believes was caused by asbestos exposure.  Lujan believes he was exposed in his youth while working at the <a rel="nofollow" href="http://www.lanl.gov/" target="_blank">Los Alamos National Laboratory</a>.  A member of New Mexico’s legislature since 1975, Lujan addressed his illness as the body opened its 2012 session, stating that he would not seek reelection to his seat.</p>
<p>In his speech, Lujan said, “This [cancer], I am certain, is the result of <a rel="nofollow" href="http://www.asbestos.net/exposure?utm_source=blog&amp;utm_medium=social&amp;utm_campaign=meso&amp;utm_content=BAN" target="_blank">exposure to asbestos</a> in my early days working on the hill in Los Alamos.” Lujan’s cancer is in stage four and requires complicated and dangerous treatments, including chemotherapy. &#8220;As a family, we gave stopping the cancer a top priority,&#8221; Lujan said. &#8220;But there also was important work to be done for the people of New Mexico. So it was important to [my wife] and I to make that sacrifice and commitment. It was a choice we don&#8217;t regret.&#8221;</p>
<p>While an outpouring of support came from his colleagues on both sides of the aisle, Lujan’s overall prognosis is not as positive. Asbestos-related cancers often result in death for its victims, as many of these diseases such as <a rel="nofollow" href="http://www.asbestos.net/mesothelioma?utm_source=blog&amp;utm_medium=social&amp;utm_campaign=meso&amp;utm_content=advocacy" target="_blank">mesothelioma</a> are notoriously hard to treat. Democratic state Sen. Mary Jane Garcia told the <a rel="nofollow" href="http://www.lcsun-news.com/ci_19763660?source=most_viewed" target="_blank">Las Cruces Sun News</a> that Lujan&#8217;s announcement cast a sobering tone for the session. &#8220;It’s such a shock. I knew nothing of this,&#8221; she said. &#8220;Stage 4 cancer, that is so heavy. But I am sure the speaker will try to keep working.&#8221;</p>

<p>Cesarean section births are no safer for premature babies than a vaginal delivery and might even increase the risk of respiratory problems and other complications such as <a rel="nofollow" href="http://www.sokolovelaw.com/legal-help/cerebral-palsy-lawyer" target="_blank">cerebral palsy</a>, according to a new study of c-section births that is gaining national attention.</p>
<p>The study was conducted by researchers at Johns Hopkins and Yale Universities and was recently presented at the annual meeting of the Society for Maternal-Fetal Medicine.</p>
<p>Speaking about the study on NBC’s “The Today Show” this morning, NBC Chief Medical Editor Dr. Nancy Snyderman <a rel="nofollow" href="http://todayhealth.today.msnbc.msn.com/_news/2012/02/09/10355322-c-sections-arent-always-best-for-preterm-babies" target="_blank">said</a> that the researchers found a 30 percent increase in medical complications in babies who were delivered via C-section. Among the medical complications noted were difficulty breathing and feeding, temperature control problems, and jaundice.</p>
<p>Additionally, she said that the medical issues could worsen over time, and that prematurely taking a baby out of the womb could increase the risk of significant long-term complications, including <a rel="nofollow" href="http://www.sokolovelaw.com/legal-help/cerebral-palsy-lawyer">cerebral palsy</a>.</p>
<p>“In the last few weeks of a pregnancy, that’s when the lungs and the brain are really developing, so developmental problems, cerebral palsy, learning disabilities, all of those things become compounded if a baby is taken out prematurely,” Snyderman said.</p>
<p>Snyderman added that the longer the baby stays in the womb – preferably for at least 40 weeks – the better the outcome will be. <p>&#8220;This is a national scandal. Urgent action is needed to prevent more pupils, teachers and other staff being <a href="http://www.asbestos.net/exposure">exposed</a> to this deadly killer dust,” said Jim Sheridan, the chairman of the group and the Labor MP for Paisley and Renfrewshire North, according to the Telegraph. &#8220;We need both far greater awareness of the risks that this material poses and a program for its phased removal.&#8221;</p>
<p>Previous reports have attributed as many as 140 UK teachers have passed away from <a href="http://www.asbestos.net/mesothelioma">mesothelioma</a> in the last decade. The new report suggests that parents, teachers, and staff receive annual updates about asbestos levels in the schools they are linked with, and that asbestos management inspections be reinstated.</p>

<p>Both parties in a criminal trial that accused a developer and real estate director of not properly removing and disposing of dangerous <a href="http://www.asbestos.net/">asbestos</a> products have pled guilty and each now face up to five years in prison.</p>
<p>The <a href="http://www.kansascity.com/2012/02/01/3404220/developer-admits-asbestos-related.html#storylink=cpy" target="_blank">Kansas City Star</a> reported that it first uncovered asbestos violations that were taking place at the city’s Citadel Plaza retail project in 2006 when it noticed that homes with asbestos products had been demolished without the proper permits being obtained.</p>
<p>The houses had been demolished to make way for a 35-acre shopping center. However, the <a href="http://www.asbestos.net/exposure">construction</a> process became delayed, and allowed areas to become contaminated with asbestos materials that had been dumped in nearby woods.</p>
<p>The asbestos contamination eventually led to the filing of a <a href="http://www.asbestos.net/asbestos-law">lawsuit</a> against William M. Threatt Jr., a developer for the project, and real estate director Anthony Crompton. Both were accused of improperly removing asbestos materials between 2001 and 2006 while overseeing the project.</p>
<p>Last year Crompton pled guilty to failing to inspect the structures that were being demolished for asbestos, and for failing to properly remove asbestos from the site. The Star recently reported that Threatt had entered a guilty plea as well for dialing to properly remove and dispose of asbestos materials.</p>
<p>Neither Threatt nor Comption have been sentenced yet. They each face up to five years in prison and a $250,000 fine.</p>

The new owner was sued in December 2011 by 34 permanent tenants who claimed airborne debris and dangerous dust containing asbestos was being caused by extensive nearby repairs.</p>

<p>According to <a href="http://dailyinterlake.com/news/local_montana/article_17f82b6a-4c85-11e1-8e5d-001871e3ce6c.html" target="_blank">The Daily Inter Lake</a>, W.R. Grace recently ended bankruptcy court litigation that has dragged on since 2001 and agreed to a $19.5 million that will fund the Libby Medical Program and transfer to a local Libby Medical Plan Trust. This will ensure that the Libby Medical Program – which was a voluntary operation started by W.R.Grace that could have been shut down at any time – will remain open.</p>
<p>The bankruptcy settlement also will establish a separate Asbestos Personal Injury Trust as part of the company’s reorganization plan. Up to two asbestos trusts to compensate asbestos and <a href="http://www.asbestos.net/mesothelioma">mesothelioma</a> personal injury claimants and property owners can be established under the reorganization plan.</p>
<p>W.R. Grace announced that the trusts will cover costs for any current and future <a href="http://www.asbestos.net/asbestos-law">asbestos claims</a>. When initially filing for bankruptcy, the company said it had been named in 110,000 asbestos-related <a href="http://www.asbestos.net/asbestos-law">lawsuits</a>.</p>

<p>An employee of the underground train system in the UK has reported that there is a significant amount of <a href="http://www.asbestos.net/">asbestos</a> throughout portions of the London Underground.</p>
<p>According to <a href="http://www.ibtimes.co.uk/articles/295229/20120208/asbestos-london-undergro" target="_blank">International Business Times UK</a>, Allen Jenkins said that asbestos was “all over the place” and worse on some train lines than others. He further said that while the areas had been painted with encapsulating paint, there was still concern that the paint could easily chip off to expose the asbestos fibers.</p>
<p>Jenkins also said that nothing will be done about it because it would cost too much money and take too long. Although safety measures have been attempted, departments do not have the proper procedures to deal with the hazard.</p>
<p>Asbestos was largely used as insulation in London’s train system until the 1980s and 1990s when laws stopped its use.</p>
