While in the hospital and ready to give birth, Tina and Ja’Kareon’s vital signs were not properly monitored by the nursing staff on hand. As a result, Ja’Kareon suffered lack of oxygen and shifted into the breach position during delivery, forcing the doctor and midwife to perform an emergency C-section birth that delivered Ja’Kareon, but not before he had developed cerebral palsy.

Even today, nearly five years later, Ja’Kareon still depends on nursing care, is fed through a tube, and cannot speak intelligibly.

Following the birth injury case that ensued, the jury found that doctors at the medical center were 100 percent negligent for the birth injury and had not acting appropriately once there were signs of distress.
