Inappropriate prescription of these products can lead to a high serum bicarbonate level in patients undergoing hemodialysis. This may contribute to metabolic alkalosis, which is a significant risk factor associated with low blood pressure, hypokalemia, hypoxemia, hypercapnia and cardiac arrhythmia, which, if not appropriately treated, may culminate in cardiopulmonary arrest. How were people injured by Granuflo?

Kidney failure can be chronic or acute. In either case, dialysis is necessary. Granuflo is used during dialysis. The science of why injury may have happened can be complex and difficult to understand but is actually very basic. The kidneys have two primary functions; to remove waste products from the body and maintain a proper pH (acid base ratio) in the blood. If waste products remain in the body and/or if the pH is not maintained correctly, the patient will likely die. The body works almost miraculously to maintain this fine balance. When the kidneys fail, an alternative must be found. A dialysis machine essentially takes over the process of filtering the blood. Chemicals are mixed and added to the blood during dialysis to keep the delicate balance between acid and base in check. The patient is monitored and chemicals added accordingly. If the blood is to acid as is usually the case when kidney failure occurs, the patient can die. If the blood is too alkaline, the patient can die. Granuflo is was used by many clinics other than those owned by Fresenius. The fact that Fresenius alerted clinics they owned but failed to notify other clinics using Granuflo about the problems, left many dialysis patients at risk.

Granuflo FDA Recall Compliance

In a discussion with between our office and the compliance division of the FDA, the FDA representative could not confirm that all clinics that possess a stock of Granuflo have yet to be notified. Although the FDA recall of Granuflo placed certain requirements on Fresenius to notify clinics that used Granuflo of the problems with the product, it is unclear at this point if Fresenius has complied with the FDA requirements. The conversation between representatives from our office and the compliance division of the FDA occurred in February of 2013.

The lack of confirmation that Fresenius Health Care has complied with FDA instructions to notify and properly educate ALL dialysis clinics using Granuflo is disturbing. Without confirmation from the FDA that Fresenius Medical Care has notified all clinics that have used Granuflo of the problems with the product, there is no way to know if dialysis patients are still at risk of being improperly dosed with Granuflo.

Is there a Granuflo Class Action Lawsuit?

02/15/2013  The Granuflo Lawsuit and Naturaltye Lawsuit are both Dialysis Lawsuit cases. The term Dialysis Lawsuit is used generically to describe both of these cases. Fresenius Medical Care is the maker of both Granuflo and Naturlyte and is the primary defendant in the ongoing dialysis lawsuit.

Granuflo and Naturalyte Dialysis Lawsuit History

Granuflo began its history in the US market in 1994 under the name Granulyte say Documents published by the FDA record the history of Granuflo from its progression from Granulyte to becoming similar products sold as Granuflo and Naturalyte . Both Granulyte and Naturalyte are dialysate concentrates used during dialysis that may be linked to hundreds of deaths. Granuflo lawyers may consider including this earlier product potential Granuflo lawsuits as a result of this discovery.

The Food and Drug Administration (FDA) records show Fresenius USA, Inc. requested approval for Granulyte Dialysate Concentrate in 1992 under the agency’s 510K accelerated approval process. According to the same document, approval was granted on 03/30/1994. The decision was based on the claim by Fresenius that the product was substantially similar to dialysis products already on the market.

Granuflo and Naturalyte Side Effects

Problems almost identical to Natualyte and  Granuflo side effects were noted early on with dialysate concentrates like Granulyte but Fresenius marched forward with the advancement of Granuflo.  In 1997 the National Institutes of Health published an abstract on “Errors in the selection of dialysate concentrates cause severe metabolic acidosis during bicarbonate hemodialysis.”

The abstract warns “Severe metabolic acidosis occurred during bicarbonate hemodialysis as the result of an error made in the selection of the dialysate concentrate. We questioned whether or not it was possible for the dialysis equipment to regulate the proportions in the dialysate fluid using an incorrect dialysate concentrate and still obtain the proper conductivity. We simulated this situation in vitro and found that during bicarbonate dialysis an inappropriately acidic dialysate fluid could replace the normal dialysate with an adequate range of conductivity still being maintained and therefore no triggering of alarms. The investigation showed that the dialysis machines were not adequately adjusted for sensitivity to the concentrates being employed during dialysis. We concluded that dialysis equipment should be fitted with on-line pH meters with alarm systems.”

Despite concerns, Fresenius seeks and gets FDA approval for branding of their dialysate concentrate under the name Granuflo. Each approval request in the products progressing has been via the FDA’s 510K accelerated approval process, popular among all drug and medical device manufacturers.

Death during dialysis while using Granuflo ultimately reached numbers significant to cause Fresenius to launch their own investigation but the public was not made aware until the FDA issued a Granuflo recall in 2012.
